These Terms of Use ("Terms") govern your access to and use of the OMO Labs LLC ("OMO Labs," "we," or "our") website at omolabs.com and the services available through it (collectively, the "Services").

1. Nature of the Services

OMO Labs is a New York State-licensed adult-use cannabis processor and distributor, regulated by the Office of Cannabis Management (OCM). Our products are sold wholesale to licensed New York cannabis dispensaries. This website is intended for licensed cannabis businesses and for adults seeking information about our products. Products are available to consumers only through licensed New York dispensaries, not directly through this website.

2. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Services.

3. Age Requirement

The Services are intended for adults 21 years of age and older, as required by 9 NYCRR Section 129.2(l). By accessing the Services you represent that you are at least 21 years old. The Services use an age-verification mechanism; by confirming your age you represent that your confirmation is accurate.

4. Use of the Services

You agree not to:

  • Use the Services in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to, interfere with, or disrupt the Services.
  • Transmit malicious code, viruses, or harmful data through the Services.
  • Impersonate any person or entity, or misrepresent your affiliation, including falsely representing that you hold a New York cannabis license.

5. No Medical Advice

Information on this website is for general informational purposes only and is not medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease. Cannabis products have not been evaluated by the U.S. Food and Drug Administration ("FDA"). Consult a qualified healthcare professional before using any cannabis product. Cannabis may have intoxicating effects and may impair concentration and coordination; do not operate a vehicle or machinery under the influence of cannabis. Cannabis is not recommended for use by persons who are pregnant or nursing.

6. Intellectual Property

All content on the Services, including text, graphics, logos, images, product descriptions, and software, is owned by or licensed to OMO Labs and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right in that content other than a limited right to view it for personal, non-commercial use.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OMO LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

9. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in the State of New York.

10. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
